This Free Account Service Agreement (“Agreement”) forms part of Kabana's Terms & Conditions. In the event of any conflict between this Agreement and the Terms & Conditions, the Terms & Conditions shall prevail. It sets the terms under which Kabana Pte Ltd (“Kabana”, “we”, “us”, “our”) provides access to its Free Account to sellers (“User”, “you”, “your”). By signing up for and using the Free Account, you agree to the following terms.
1.1. The Free Account is provided at our sole discretion, and we reserve the right to terminate, suspend, or discontinue the Free Account at any time and for any reason, subject to our obligations under applicable law. Termination of your Free Account does not affect your rights under the Personal Data Protection Act 2012 (Singapore) or any other applicable law.
1.2. We are not responsible for any loss or inconvenience caused by the discontinuation of the Free Account, subject to clause 1.1 above.
2.0. Free Account limits. The Free Account currently includes: 1 store connection, 3 months of historical data, access to the Performance Dashboard, and data refreshes every 24 hours. Kabana may revise these limits at any time with 14 days' prior written notice. Current Free Account limits are published at usekabana.com/pricing.
2.1. The Free Account is offered under a fair use policy and is intended for reasonable, non-excessive use by individual sellers for their own business analytics.
2.2. Users are expected to use the Free Account responsibly. The following are considered violations of fair use: (a) connecting more than 1 store simultaneously, or generating API call volumes that materially degrade platform performance for other users, as determined by Kabana's monitoring systems; (b) using automated tools, scripts, or bots to extract data outside the normal Kabana interface; (c) using the Free Account for commercial purposes disproportionate to personal or small-business use — for example, reselling analytics data or using the service to power a competing product; (d) fraud, misrepresentation, or deliberate abuse of the service.
2.3. If Kabana determines in good faith that a user has violated this Policy, Kabana may: (a) for non-urgent violations, provide the user with written notice (email to registered address) and a 5-business-day opportunity to cure the violation; or (b) for fraud, security threats, or violations causing immediate harm to the platform or other users, suspend or terminate the account immediately without prior notice. In either case, Kabana will inform the user of the reason for suspension or termination promptly after the action is taken.
2.4. If your usage consistently exceeds Free Account limits, we may invite you to upgrade to a paid subscription plan. Details of paid plans are available at usekabana.com/pricing.
3.1. The Free Account is provided on an “as-is” and “as-available” basis, with no guarantees regarding uptime, availability, or continued access.
3.2. We reserve the right to modify, limit, suspend, or discontinue the Free Account at any time. Where reasonably practicable, we will provide 14 days' prior notice of material changes to features or limits.
3.3. Service interruptions or downtime may occur at any time, including for maintenance, technical issues, or other operational reasons. We are not liable for any disruptions or losses resulting from such occurrences.
4.1. Free Account users do not receive dedicated support.
4.2. Responses to inquiries are not guaranteed, and support is provided at our discretion.
5.1. Kabana collects and processes your personal data in accordance with our Privacy Policy, which is incorporated into this Agreement by reference. By using the Free Account, you acknowledge that you have read and agree to the Privacy Policy. In the event of any conflict between this section and the Privacy Policy, the Privacy Policy prevails.
5.2. We do not guarantee data backups or data recovery for Free Account users.
5.3. If Kabana terminates or suspends your Free Account under clause 2.3(a) (non-urgent violations), we will notify you by email and provide you with 14 calendar days to export your data before it is deleted. If the termination is for fraud or security reasons under clause 2.3(b), no export window is guaranteed. After the applicable window, your data will be deleted or anonymised in accordance with our Privacy Policy.
6.1. This Agreement is governed by the laws of Singapore.
6.2. Any disputes will be handled in accordance with the dispute resolution process set out in the Terms & Conditions, and ultimately in the courts of Singapore.
7.1. We may update this Agreement at any time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Free Account after updates constitutes acceptance of the new terms.
If you do not agree to these terms, please do not sign up for or use the Free Account.
